These Terms of Use (“Terms”) are a binding agreement between you and BamBamTastic Games, LLC (“BamBamTastic”, “we”, “us” or “our”), covering your use of the website bambamtastic.com and the mobile game Find Serve Keep (FSK) (together, the “Services”).
By downloading, installing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
We are a limited liability company registered in Florida, United States, with a registered office at 8815 Conroy Windermere Rd, Orlando, FL 32835, United States.
1. Eligibility and age
You must be at least 13 years old to use the Services. If you are under the age of majority where you live (usually 18), you may use the Services only with the involvement and consent of a parent or guardian, who agrees to be bound by these Terms on your behalf. In the UK and EEA, if the digital-consent age where you live is higher than 13, that higher age applies.
2. Licence to use FSK
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use FSK on a device you own or control, for your own private non-commercial entertainment. On Apple devices this licence is governed additionally by section 13 below.
You may not: copy, modify, translate, reverse engineer, decompile or disassemble the Services except where that restriction is prohibited by law; rent, lease, lend, sell or sublicense them; remove proprietary notices; use cheats, bots, automation, modified clients or exploits; access the Services through unauthorised means; or use them for any unlawful purpose.
3. Your account
You may create an account using Facebook Login or Sign in with Apple. You are responsible for activity under your account and for keeping your sign-in credentials secure. Tell us promptly at info@bambamtastic.com if you believe your account has been compromised. You may delete your account at any time — see our Account & Data Deletion page.
4. Purchases and virtual items
FSK may offer virtual currency, boosters and other virtual items (“Virtual Items”). The following applies to all of them:
- Virtual Items are licensed to you, not sold. You do not own them.
- They have no monetary value and cannot be exchanged for money, goods or anything of value outside the game.
- They are non-transferable and cannot be traded or sold to other players.
- We may modify, manage, suspend or remove Virtual Items at any time, including for game balance.
- Your rights to Virtual Items end if your account is terminated or the game is discontinued.
All purchases are processed by Apple or Google and are subject to their terms. Purchases are final and non-refundable except where required by law. Refund requests must be made to Apple or Google, not to us, because we do not process the payment.
5. User conduct
You agree not to harass, threaten or abuse other players; impersonate anyone; upload unlawful, infringing or harmful content; attempt to gain unauthorised access to any system; interfere with or overload our infrastructure; or encourage anyone else to do these things.
6. Intellectual property
The Services, including all game code, artwork, characters, audio, text, designs and the BamBamTastic and Find Serve Keep names and logos, are owned by us or licensed to us and are protected by copyright, trademark and other laws. Except for the licence in section 2, no rights are granted to you.
If you send us feedback, ideas or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without obligation or compensation to you.
7. Third-party services
The Services integrate with third parties including Apple, Google, Meta, Firebase and GameAnalytics. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
8. Availability, updates and termination
We may change, suspend or discontinue any part of the Services at any time, including ending support for FSK entirely. We may update the game, and some updates may be required for it to keep working.
We may suspend or terminate your access if you breach these Terms, if we suspect fraud or abuse, or if required by law. You may stop using the Services at any time and delete your account. Sections 4, 6, and 9 to 12 survive termination.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free or secure.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits your statutory consumer rights.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAMBAMTASTIC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL OR GAME PROGRESS. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$50.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
11. Indemnification
You agree to indemnify and hold harmless BamBamTastic Games, LLC and its officers, directors, employees and agents from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Services.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Subject to the paragraph below, the state and federal courts located in Orange County, Florida will have exclusive jurisdiction.
If you are a consumer resident in the UK, EEA or another jurisdiction whose law gives you the right to bring proceedings locally, nothing in these Terms removes that right, and you retain the protection of the mandatory consumer laws of the country where you live.
Before filing a claim, you agree to contact us at info@bambamtastic.com and attempt to resolve the dispute informally for at least 30 days.
13. Apple App Store — additional terms
These terms apply if you obtained FSK from the Apple App Store, and are required by Apple.
- Acknowledgement. These Terms are between you and BamBamTastic Games, LLC only, not with Apple. We, not Apple, are solely responsible for FSK and its content.
- Scope of licence. The licence granted is non-transferable and limited to use on Apple-branded products that you own or control, as permitted by the App Store Usage Rules, except that FSK may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing maintenance and support for FSK. Apple has no obligation whatsoever to furnish any maintenance or support services.
- Warranty. We are solely responsible for any product warranties, whether express or implied. If FSK fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to FSK.
- Product claims. We, not Apple, are responsible for addressing any claims relating to FSK, including product liability, failure to conform to legal requirements, and claims under consumer protection or similar legislation.
- Intellectual property. If a third party claims FSK infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.

- Third-party terms. You must comply with applicable third-party terms when using FSK.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
14. Google Play — additional terms
If you obtained FSK from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for FSK. Refunds for Google Play purchases are handled under Google's refund policy.
15. General
These Terms, together with our Privacy Policy, are the entire agreement between us regarding the Services. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
We may update these Terms. We will change the “Last updated” date and, for material changes, give notice in the game or on this site. Continued use after changes take effect means you accept them.
